Welcome to the Saugat Community Welfare Society (SCWS) web portal. This document constitutes a legally binding agreement between you (the "User", "Donor", or "Member") and Saugat Community Welfare Society ("SCWS", "we", "our", or "us"). By registering, accessing, browsing, or utilizing our website and integrated services, you explicitly agree to be bound by these exhaustive Terms and Conditions. If you do not agree with any part of these terms, you must immediately cease your use of our platform.

1. Definitions & General Overview

"Platform" refers to the SCWS official website, integrated API endpoints, administrative dashboards, and related mobile applications.
"Services" encompasses the facilitation of charitable donations, subscription processing, volunteer onboarding, and community welfare awareness programs.
"User" means any individual, corporate entity, or legal representative accessing the platform.

2. Eligibility & Account Registration

By utilizing this platform, you represent and warrant that you are at least 18 years of age and possess the legal capacity to enter into binding contracts under the Indian Contract Act, 1872. Minors must access the portal strictly under the supervision of a legal guardian.

Upon registration, you are assigned a unique Member ID (CISD). You agree to provide accurate, current, and verifiable information. SCWS reserves the unilateral right to suspend, lock, or terminate accounts containing false, misleading, or deceptive data. You are solely responsible for safeguarding your login credentials. Any activity conducted under your account will be deemed your legal responsibility.

3. Comprehensive Donation, Payment & Refund Policy

SCWS is a registered non-profit entity. All funds remitted through this portal are considered voluntary charitable contributions aimed at executing our welfare initiatives. Therefore, the following strict financial regulations apply:

  • Strictly Non-Refundable: All donations, whether one-time or recurring subscriptions, are final. Once a transaction is successfully authorized by the payment gateway and verified by our backend, the funds are irrevocably allocated to the designated cause. SCWS entertains zero refund requests for completed donations.
  • Subscription Mandates: If you opt for a recurring donation (e.g., Monthly, Yearly), you authorize SCWS (via its banking partners) to periodically collect the specified amount. You may cancel your mandate via your dashboard prior to the next billing cycle.
  • Technical Failures & Double Deductions: In the rare anomaly of a technical network failure resulting in multiple deductions for a single intent, you must contact our support desk within 48 hours with your Reference ID (`SUB-`, `MAN-`, or `POS-`) and bank statement. Upon reconciliation with our merchant gateway, excess duplicate charges will be reversed within 7-10 business working days.
  • Tax Exemptions: Tax exemption certificates (e.g., under Section 80G of the Income Tax Act, if applicable to the specific cause) will be generated automatically and made available on your dashboard. However, SCWS does not guarantee tax benefits; it is the donor's liability to consult a tax advisor and utilize the provided receipts appropriately.

4. Prohibited Conduct & Platform Integrity

You agree to use the SCWS Platform strictly for lawful purposes. You are expressly prohibited from engaging in any of the following activities:

  • Fraudulent Submissions: Uploading manipulated, fake, or totally irrelevant images/screenshots to bypass the manual payment verification queue. This will result in an immediate and permanent IP ban.
  • API & Security Abuse: Attempting SQL injections, cross-site scripting (XSS), tampering with dynamic QR code generators, or attempting to reverse-engineer our backend systems.
  • Data Scraping & Bots: Utilizing automated scripts, spiders, or scrapers to extract user databases, financial metrics, or organizational structures from the portal.
  • Impersonation: Falsely representing yourself as an SCWS admin, employee, or official agent to solicit funds from the public outside the secure boundaries of our official portal.

5. Intellectual Property Rights (IPR)

The entirety of the content residing on this Platform—including but not limited to the SCWS logo, brand names, software code, UI/UX designs, campaign graphics, written text, and database architectures—is the exclusive intellectual property of Saugat Community Welfare Society and is protected under the Indian Copyright Act, 1957, and the Trade Marks Act, 1999. You are granted a limited, non-exclusive, revocable license to access the portal for personal, non-commercial use. Any unauthorized reproduction, distribution, or commercial exploitation is strictly prohibited.

6. Third-Party Links & External Gateways

The Platform may contain links to external third-party websites, including banking gateways and payment processors. These external links are provided solely for your convenience. SCWS exercises no control over the content, privacy policies, or security protocols of these external sites. You acknowledge that navigating to third-party portals is done entirely at your own risk.

7. Disclaimer of Warranties

We dedicate immense effort to ensure the platform operates smoothly; however, technical infrastructures are inherently unpredictable.

8. Limitation of Liability

To the maximum extent permitted by applicable law, under no circumstances shall Saugat Community Welfare Society, its directors, employees, volunteers, or affiliates be held liable for any direct, indirect, incidental, punitive, special, or consequential damages (including loss of data, revenue, or digital access) arising out of or in connection with your use or inability to use the platform. In jurisdictions where exclusion of liability is not allowed, SCWS's total liability to you for any claim shall not exceed the amount of your most recent verified donation, or INR 1,000, whichever is lower.

9. Indemnification

You agree to indemnify, defend, and hold harmless SCWS and its associates from and against any and all legal claims, damages, liabilities, costs, and expenses (including reasonable legal/attorney fees) arising from: (a) Your violation of any provision of these Terms and Conditions; (b) Your misuse of the Platform; or (c) Your infringement of any intellectual property or privacy rights of a third party.

10. Account Suspension & Termination

SCWS reserves the absolute right to suspend, deactivate, or permanently delete your account and block your IP address without prior notice or liability if we detect any breach of these Terms, suspicion of fraudulent activity, or behavior that harms the reputation of the NGO. Upon termination, your right to use the Platform ceases immediately.

11. Severability & Waiver

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that specific provision shall be limited or eliminated to the minimum extent necessary so that the remainder of the Terms shall otherwise remain in full force and effect. The failure of SCWS to enforce any right or provision of these Terms will not be deemed a waiver of such right.

12. Modifications to the Terms

We reserve the right to modify, amend, or replace these Terms and Conditions at any time. Significant changes will be communicated via a prominent notice on our website or directly to your registered email. Your continued use of the Platform following the posting of any changes constitutes your formal acceptance of the revised Terms.

13. Governing Law & Dispute Resolution

These Terms and Conditions shall be governed by, and construed in accordance with, the laws of the Republic of India. Any disputes, controversies, or claims arising out of or relating to this agreement shall first be subjected to mandatory mediation. If unresolved, the dispute shall be subject to the exclusive jurisdiction of the competent courts located within the registered state of the SCWS headquarters.
